Military Policing Illegally used at Kentucky Derby

On Saturday May 2, 2009 military police were illegally used to police the 135th running of the Kentucky Derby at Churchill Downs.

I saw this story and knew that it was one of great concern to all of us law abiding citizens in America. The military has been brought in to police events and even cities lately and this is an issue that needs to be strongly addressed with your state representatives today! We need to demand answers as to why it has all of sudden become a practice to use military police when it is clearly illegal unless there is a heightened level of a state of emergency which is only to be permitted under an executive order. Did President Obama give out the executive order to police the Kentucky Derby? If so, Was he afraid of the wealthy neocons getting out of hand?

Not only has our military been used at the Kentucky Derby, but there was a recent illegal dispatching of soldiers in Samson, Alabama, from nearby Fort Rucker after a murder spree on March 10, 2009 as reported on Alex Jones’ Info Wars. As many of us know, this form of dispatching of troops is a direct violation of the Posse Comitatus Act prohibiting the military from participating in law enforcement activities.

Who knows? The next illegal dispatching of our military to police the law abiding citizens of America might take place during the Independence Day Tea Party events that will be happening in a town or city near you. Please take a moment and do your own research on this important issue and then contact your representatives and demand answers and then demand that this blatantly illegal usage of our military will not be tolerated.

    These are Kentucky National Guard MP’s. They were ordered to State active duty under KRS 38.030 which states-
    KRS 38.030 art. 1a
    The Governor may order units and individual members of the Kentucky National Guard into state active duty for any of the following purposes:
    1. Protecting lives and property;
    2. Assisting in disaster relief or other humanitarian efforts;
    3. Preventing or suppressing riot or civil disorder;
    4. Enforcing the laws of the Commonwealth; or
    5. Other similar purpose.
    The MP’s were under the command of KY state and municipal police, not federal or military.
    KRS 38.030 art. 2
    The Governor may direct the commanding officer of the military forces ordered to state active duty to report to any civil officer, including, but not limited to, judge, county judge/executive, mayor, sheriff, or head of law enforcement or other public agency in whose jurisdiction the state active duty mission is to be performed. The civil officer may advise the commanding officer regarding the specific objectives to be accomplished by the military force, but the tactical direction and disposition of the troops and the particular means to be employed to accomplish the mission shall be left solely to the commanding officer of the National Guard.

    I am one of these MP’s and I can tell you that using the guard is much cheaper than paying civilians for the same job. This IS a money saving tactic. I make about $80 per day but the shift may be 14-20 hours. Do the math. A civilian security contractor or a police officer, making shift differential, would cost 3 to 5 times that amount. After the security part is over, they use us as slave labor to clean up, which is also cheaper than paying more civilians to pick up trash. I would be very happy if you could keep me from having to babysit drunks, keep idiots from killing each other over a parking spot and being used as slave labor to pick up a place that effectively resembles a trash dump after “everyone else” in the city enjoyed the festivities.

    actual wording from the law.

    these soldiers are not there to inforce martial law, only to beef up the security at the derby. without this kind of help they would be hiring people off the street, giving them weapons and telling them there the police….. think about it.
