Update on Russells – Judge Overrules Johnson’s JP Court Judgement

The latest update on the Remuda Ranch Estates Association vs Johnnie and Clara Russell lawsuit:

January 5th the Russells were back in court where the Judge overruled the previous court decision, ruling instead in favor of the Russells, which eliminated the bond payment requirement and opened the door for the Russells to appeal the original decision against them in District court. A court date has not yet been set, but it is anticipated to be done in the next week or two.

Along with this victory, other interesting issues have occurred:

The Russells had their land surveyed and discovered that the sign in question was in fact not placed on their property, but was actually placed about four feet away from their property line – on county land. The county maintains the land on which the sign was placed, coming out about three times a year to mow or clear brush. Anyone could have removed the sign at any time, but did not do so. Due to the fact that the sign was not on the Russell’s property, the charge by the HOA that the Russells have violated a deed restriction should be thrown out.

Verdict is in on the ‘Wake Up America’ sign started by Talk Host Glenn Beck

After a long two and a half weeks of waiting, the verdict is finally in on the Russell’s appeal for inability to pay the bond issued by Judge Lynn Marie Johnson in Pct. 4 Parker County, Texas JP Court. As you might recall, the evidence was submitted on December 1, 2011 and the Russells finally received their verdict on Tuesday, December 20, 2011. This update has been delayed as I researched the claims made by the judge in the judgement itself.

After reviewing this verdict and speaking with the Russell’s attorney, Joshua Cardin, I’ve come to understand the bizarre nature of this verdict. From the information I was provided, the verdict should have just contained the last sentence found in Judge Johnson’s latest verdict which stated,

“It is hereby ORDERED, ADJUDGED, AND DECREED that Defendants Affidavit of Inability to pay costs is denied.”

Instead, the verdict contained a long justification for the Judge’s decision which displays a trend of the judge either not listening during the presentation of evidence during the initial trial, or it shows the judge’s associations with Remuda Ranch Association board members and adds further merit to where the judge should have recused herself from this … Read the Entire Story

Herring Resigns from HOA Board Over Remuda HOA vs Russells Lawsuit

Numerous sources are now telling me that Parker County, Texas Precinct 400 Chair, Marvin Herring, has been vocal in telling everyone who will listen that he has now resigned from the Remuda Ranch Estates Homeowners Association Board. Others are saying that they just won’t believe it until they see an official resignation announcement. I did try to contact Mr. Herring about his resignation from the board and was unable to reach him for comment. His resignation is taking place at a time when there is a great deal of pressure in Parker County to resolve the lawsuit brought on by the hoa against Johnnie and Clara Russell (vague updates on this lawsuit available at the bottom of this story).

During our research we were most surprised when we learned that Marvin’s wife, Peggy Herring, just happens to be the Parker County Democratic Party Precinct 400 Chair. Wouldn’t this kind of partnership make for an exciting conversation during your evening meal? We’ve also been told that Mr. Herring proudly voted in favor of a shooting ban ordinance in Parker County in subdivisions with 10 acres or less which put several gun instructors in the county out of business. Update: Remuda Estates HOA vs Russells Case

I’m sad to say that we have little for updates at this time. The December 1, 2011 postponement date has clearly passed with all evidence being submitted by the parties’ attorneys on that date for review by Justice of the Peace Lynn Marie Johnson. Currently there still has been no known verdict received by the Russell couple or their attorney.

Interesting note: Claire Russell was scheduled to speak at a Parker County Tea Party meeting last night when, to their surprise, Judge Johnson showed up at the meeting with a City Counsel member at her side. After communications with several members of the group last night, nobody is quite sure why Johnson decided to attend her first Parker County Tea Party meeting last night, December 6, 2011. I was told that she had previously, before the Russell case, been given an open invitation to attend a meeting. Members treated her with respect and she did the same during this meeting of the Parker County Tea Party. I will make mention that the issues with this Remuda Estates HOA began long before Judge Johnson took the seat in the Parker County Pct. 4 courtroom.

My original plans for today’s update were to expand on the evidence acquired during my in depth investigation into the Russells being sued by the neighborhood homeowner’s association over a “WAKE UP AMERICA – Defend Your Liberties” sign associated with talk radio host Glenn Beck. Rather than provide any updates right now, I will just refer you to a debate now taking place between the HOA President and residents of the Remuda Ranch Estates in the comments section of yesterday’s story.

Look for Clara and Johnnie Russell’s appearance on GBTV during tomorrow’s (11-29-2011) program as they have been invited as a guest on Glenn Beck TV to tell their story about how their Civil Liberties came under attack for a posting this simple sign that has no political motivation other than wanting Americans to wake up and learn how to make educated voting decisions no matter what their party affiliation.

The key to finding out more about the Clara and Johnnie Russell lawsuit lies deep within the history of the Remuda Ranch Estates Homeowners Association board members where we will find out what it is this group of bullies is truly trying to accomplish with these frivolous lawsuits they have repeatedly filed against residents (numerous cases now) of the Remuda Ranch Estates.

After many discussions with residents of the estates, I have managed to dig up many new details which include numerous attacks and threats against residents posting this “WAKE UP AMERICA – Defend your Liberties” sign that is now in question with the ongoing Russell lawsuit. Some of the threats have been sent by board members via text messages and emails. There is one member of the board whose name continues to stand out and residents keep telling me she is behind most of the HOA issues while using the others as her pawns to do the dirty work for her. I won’t get into details about who this individual is in today’s story.

Taking a Better Look into Conflicts of Interest in Parker County, Texas Regarding Russell Case

This story continues to get more complicated and broader the further we dig into it. On Wednesday I reported on catching Judge Lynn Marie Johnson and her friend Kathy Kornegay Chruscielski red-handed after they had been busy covering up their tracks of friendship. Judge Johnson removed or hid a number of photo albums on her facebook page, which were previously accessible by the public, while Kathy decided she better change her privacy settings to private instead of public under facebook’s privacy settings.

Below you are going to find a, (previously captured) photo Mrs. Chruscielski had posted on her facebook while tagging Johnson on March 9, 2010 along with offering her endorsing comments under the photo.

Kathy’s comment under the photo reads,

Photo Comment says, Kathy Kornegay Chruscielski… thinks Lynn Marie Johnson would make an excellent Justice of the Peace for Parker County Pct 4 – this portrait was made yesterday in my home studio. I know Lynn through her community service with the Aledo Advocats. As the Parker County, Texas case continues to unfold, Clara Russell finds her way onto Glenn Beck’s radio program on Tuesday, November 22, 2011 to tell the story about how she and her husband Johnnie were singled out to remove their “Wake Up America” sign while neighbors were proudly displaying signs of all types in their yards.

The interview began with a brief summary of the case by Glenn and then continued with Clara filling in some details.

On Wednesday, November 23, 2011, Mrs. Russell went on the Doug Giles program for a second interview to tell the Russell’s story, that details currently being uncovered in our investigation are seeming to lead to a much broader County wide level of corruption largely based on politics and a good ole’ boys network of the who’s who in Parker County, Texas. The Conflicts of Interest Keep Getting More Interesting when in Parker County, Texas

One might be asking why I am on this story so hot and heavy? This story isn’t just about issues in Parker County, Texas. It’s a story that is taking place all across the country. It’s a common story of political, or judicial as in this case, assassination of good honest people just like Clara and Johnnie Russell who take great pride in their country instead of being haters of America. Nobody in their right mind would make a judgement of over $7,000 over a measly little sign that was harming nobody if there wasn’t something else to be gained in doing so. Nobody!

With that statement out of the way, let’s move on with today’s discoveries.

It appears a couple of friends in the Parker County, Texas area have been a quite busy since my last update. Perhaps it is an effort to cover up any concerns over a conflict of interest. Yesterday started off very hectic for Clara and Johnnie Russell as word of their lawsuit spread around the country after The 912 Project Fan Site and The Blaze decided to do stories about the lawsuit that had been filed against them for posting a sign supporting their local 912 Project group.

After Claire, as Mrs. Russell is otherwise known, had spent a great deal of time trying to get someone to take up her issue and do a story that would help stop all this nonsense she and her husband Johnnie were going through because of their support for the Glenn Beck idea of “Wake Up America”, she stumbled upon me and sent me a message with her story.

In a recent verdict, a North Texas couple located in Parker County found out just how much their Constitutional Rights to Freedom of Speech could cost them after posting a sign simply stating, “WAKE UP AMERICA – Defend Your Liberties” which promotes Glenn Beck’s wake up America project. All of a sudden this sign became an issue after the sign had already been in place for nearly three years.

During a phone conversation with Clara Russell, she told me that she had purchased the sign after attending a Fort Worth, Texas 912 Project Rally. She was so inspired by the gathering, the quality of people, and the message, she felt she needed to do her part and purchased the sign. Schools all over Wisconsin have been closed since Tuesday because of illegally striking teachers angry about Governor Walker’s proposals that they contribute to their own pensions and health care and some loss of collective bargaining rights. Many claim it isn’t about the money, it’s the collective bargaining issue. They claim that without the ability to collectively bargain Wisconsin’s schools will lose its talented teachers and other top-rated public employees because the benefits they currently enjoy will be minimized under Walker’s plan. Because when it comes down to it, it’s really about the kids, right? Without the great benefits these teachers and other public employees enjoy, a diverse school district like Milwaukee, for example, would experience one of the highest achievement gaps between white and minority students in the country, have a graduation rate of less than 70% for all students, have only 40% of 10th-12th graders proficient in reading and only 30% of 10th-12th graders proficient in math. But wait, this is where the MPS district already stands – with the exceptional benefits the unions are fighting to retain. So, if the union loses everything they’ve been protesting about for the last week, are they saying that these stats will get worse?

On Thursday, January 27, 2011, Michelle Obama visited Fort Jackson in South Carolina and met with Lt. Gen. Mark Hertling. The Lt. Gen. has been working to change the Army’s diet and exercise programs in order to improve the fitness our military men and women. According to news reports, Ms. Obama told the Lt. Gen. that she “was fascinated by the project” and reiterated her oft-repeated statement “that lack of fitness is ‘not just a health issue but a national security issue.’”

First lady: Military could make U.S. fit

FORT JACKSON, S.C. — First lady Michelle Obama said Thursday that the military’s push to turn recruits into health-conscious warriors could be a model for making people across the U.S. more focused on fitness and nutrition.

Obama, who has made battling childhood obesity one of her signature causes as first lady, visited the Army’s largest training post at Fort Jackson outside Columbia to see what the Army has done, from more rigorous training drills to fat-free milk in its mess halls.

Michelle Obama: Please Keep Whining

Forbes Magazine‘s has announced that Michelle Obama tops their 100 Most Powerful Women list:

“At the top of our list, First Lady Michelle Obama is a true change-maker since taking lodge in the White House in 2008. The first African-American in the post, she’s changed the face of the office (literally), and with consistently high approval ratings, she’s given a new generation of girls and women around the world a role model. A former private attorney and public servant in Chicago, her interest in working with young people and advocating for healthy eating, among other issues, is evidenced by her Let’s Move! campaign, which aims to solve the epidemic of childhood obesity within a generation.”

The role as First Lady of the United States doesn’t seem to be sitting well with Ms. Obama who apparently finds the job so difficult that The National Enquirer (which broke the news of John Edwards’ affair two years before the MSM touched the story) is reporting that the day after the First Family returned from vacation at Martha’s Vineyard, Ms. Obama could be heard screaming at her husband:
