The latest update on the Remuda Ranch Estates Association vs Johnnie and Clara Russell lawsuit:

January 5th the Russells were back in court where the Judge overruled the previous court decision, ruling instead in favor of the Russells, which eliminated the bond payment requirement and opened the door for the Russells to appeal the original decision against them in District court.  A court date has not yet been set, but it is anticipated to be done in the next week or two.

Along with this victory, other interesting issues have occurred:

The Russells had their land surveyed and discovered that the sign in question was in fact not placed on their property, but was actually placed about four feet away from their property line – on county land.  The county maintains the land on which the sign was placed, coming out about three times a year to mow or clear brush.  Anyone could have removed the sign at any time, but did not do so.  Due to the fact that the sign was not on the Russell’s property, the charge by the HOA that the Russells have violated a deed restriction should be thrown out.

Less than a week later, Clara Russell was disturbed by her dogs’ barking; looking out a window she realized that Shelby Dougherty (Secretary of the Remuda Ranch Estates HOA) was on her property with a surveying crew, surveying the Russell’s property (even though the Russell’s attorney had provided the court with the results from the survey the Russells had done themselves).  The police were called and Shelby Dougherty was issued a citation for Criminal Trespass and warned that if she ventured onto the Russell’s property again, she would be arrested.

Clara Russell was upbeat when I talked to her today, saying that she expects the Remuda Ranch Estates Association to be forced to drop the case due to the fact that the HOA has run out of money.  In November, the HOA had about $3400 left (out of $54,000 the association received through a gas-drilling lease from Barnett Shell, which the HOA has used for some improvements but also to pay for court costs incurred by the lawsuits the HOA has been involved in).  Since then, there have been several court appearances, which should have eaten the rest of the HOA’s funds.  According to Ms. Russell, each party must have representation in District court – without the money for an attorney, the HOA may be forced to drop the complaint against the Russells.

 

Editor’s note: Shelby’s name has come up in numerous interviews and was quite vocal in a recently released video of a Remuda Ranch Estates HOA board meeting titled, “Bad HOA’s Gone Wild”. You can see her wearing a bluish shirt and glasses nearest to the video camera in the video shown below.

I have also been provided copies of text messages Mrs. Dougherty allegedly sent HOA resident David Ray regarding another “Wake Up America” sign that the board thought was on his property. The sign happened to be on the gate of the adjacent property which was outside the HOA’s jurisdiction. You can see these threatening text messages in the following photos.

I’m sad to say that we have little for updates at this time. The December 1, 2011 postponement date has clearly passed with all evidence being submitted by the parties’ attorneys on that date for review by Justice of the Peace Lynn Marie Johnson. Currently there still has been no known verdict received by the Russell couple or their attorney.

Interesting note: Claire Russell was scheduled to speak at a Parker County Tea Party meeting last night when, to their surprise, Judge Johnson showed up at the meeting with a City Counsel member at her side. After communications with several members of the group last night, nobody is quite sure why Johnson decided to attend her first Parker County Tea Party meeting last night, December 6, 2011. I was told that she had previously, before the Russell case, been given an open invitation to attend a meeting. Members treated her with respect and she did the same during this meeting of the Parker County Tea Party. I will make mention that the issues with this Remuda Estates HOA began long before Judge Johnson took the seat in the Parker County Pct. 4 courtroom.

An interesting comment, by one of the groups members, made regarding the Judge’s attendance last night,

“Well maybe Judge Johnson learned something about the Constitution and what we stand for by being there last night, she certainly hasn’t silenced anyone.”

Because of Judge Johnson’s being in attendance, Claire Russell’s attorney, Joshua Carden, advised her to postpone her speaking engagement in an effort to prevent any potential legal repercussions with regards to their current ongoing case to which they have yet to receive judgement on their bond hearing.

Since my last update on this issue, I’ve since learned that Real Estate Agencies have been refusing to list homes from the Remuda Ranch Estates. According to residents of the HOA, this issue dates back to a time previous to the Russell’s case being aired.

Wake Up America sign seen at Clara and Johnnie Russells

Sign that is costing the Russells over $7,300

My original plans for today’s update were to expand on the evidence acquired during my in depth investigation into the Russells being sued by the neighborhood homeowner’s association over a “WAKE UP AMERICA – Defend Your Liberties” sign associated with talk radio host Glenn Beck. Rather than provide any updates right now, I will just refer you to a debate now taking place between the HOA President and residents of the Remuda Ranch Estates in the comments section of yesterday’s story.

The key to finding out more about the Clara and Johnnie Russell lawsuit lies deep within the history of the Remuda Ranch Estates Homeowners Association board members where we will find out what it is this group of bullies is truly trying to accomplish with these frivolous lawsuits they have repeatedly filed against residents (numerous cases now) of the Remuda Ranch Estates.

After many discussions with residents of the estates, I have managed to dig up many new details which include numerous attacks and threats against residents posting this “WAKE UP AMERICA – Defend your Liberties” sign that is now in question with the ongoing Russell lawsuit. Some of the threats have been sent by board members via text messages and emails. There is one member of the board whose name continues to stand out and residents keep telling me she is behind most of the HOA issues while using the others as her pawns to do the dirty work for her. I won’t get into details about who this individual is in today’s story.

The current members of the Remuda Ranch Estates Homeowners Association board consist of:

  • Tommy Stewart (President)
  • Kathy Chrushielski (Vice President) (Previously mentioned as a friend of Judge Johnson)
  • * Shelby Doughtery (Secretary)
  • Susan Baird (Treasurer)
  • Werner Pegg (Zones Director)
  • Marvin Herring (Zone Director) (Who is also their GOP PCT Chair)
  • Robert Montgomery (Zone Director)

The members or residents who have tag-teamed as the past Presidents of the HOA Board are:

  • Tommy Stewart
  • * Shelby Doughtery
  • Wes Oliver
  • Steve Coburn

Let’s just take a quick look at the current Remuda Ranch Estate Homeowners Association board President.

Thomas (Tommy) Stewart

Tommy Stewart (Cowboy at large)

His name is Thomas (Tommy) Stewart. Tommy likes to sport the look of a angry cowboy while displaying a large caliber pistol and wearing a Obama T-shirt with a big Texas background at the same time. I’m betting you are thinking the same thing I am right now. There are just some things that don’t match in my description, but you can see for yourself in a profile picture he proudly displays (seen to the left).

Tommy likes to enforce the HOA’s rules on his neighbors who proudly display “WAKE UP AMERICA” signs, but doesn’t have much regard for the sign rules himself as you will see in some photos I will show you below.

He also likes to write the Star-Telegram to attempt to justify the boards iron-fisted actions to attack the Civil Liberties of the estate’s residents.

Here’s a short explanation provided by Tommy in op-ed,

For 38 years, the rule prohibiting certain signs in Remuda Ranch Estates has been part of the deed restrictions. (See: “No politics, please: We’re homeowners,” Bud Kennedy, Nov. 18)

Temporary allowances are made for political signs during elections, school spirit signs (90 days) and seasonal displays (90 days).

None of the allowances seem to list the signs Mr. Stewart does and has recently had posted on his property.

This story continues to get more complicated and broader the further we dig into it. On Wednesday I reported on catching Judge Lynn Marie Johnson and her friend Kathy Kornegay Chruscielski red-handed after they had been busy covering up their tracks of friendship. Judge Johnson removed or hid a number of photo albums on her facebook page, which were previously accessible by the public, while Kathy decided she better change her privacy settings to private instead of public under facebook’s privacy settings.

Below you are going to find a, (previously captured) photo Mrs. Chruscielski had posted on her facebook while tagging Johnson on March 9, 2010 along with offering her endorsing comments under the photo.

Kathy’s comment under the photo reads,

Photo Comment says, Kathy Kornegay Chruscielski… thinks Lynn Marie Johnson would make an excellent Justice of the Peace for Parker County Pct 4 – this portrait was made yesterday in my home studio. I know Lynn through her community service with the Aledo Advocats. She is dedicated to reducing crime, improving revenue and implementing Teen Court to bring our court in line with the rest of Parker County.

As I previously reported on Wednesday, The Conflicts of Interest Keep Getting More Interesting when in Parker County, Texas, Kathy sits on the Remuda Ranch Estates Homeowners Association board. That’s right! The same board that has sued Clara and Johnnie Russell for a sign posted on ‘their’ property which, according to documents, did not belong to the HOA to begin with. A couple of words really stand out in Chruscielski’s comment under the above photo, ” improving revenue”. Could this “improving revenue” have something to do with the connection between the two? There may very well be a good chance of that. Regardless, those words should be of great concern to citizens in this Parker County, Texas Pct 4. Is it a judge’s place to improve revenue or to uphold the law? According to all I’ve learned and know about our judicial systems, I believe it to be safe to say the latter of the two would and should be the answer and should be the primary focus of any judge.

Here is another photo of Lynn Marie Johnson’s swearing in ceremony as Justice of the Peace for Parker County, Texas Pct 4. Sure enough, it was found on Kathy’s facebook with Judge Johnson being tagged in it.

The proud comments, by Chruscielski, on her facebook photo read,

Doesn’t this cause a clear ‘CONFLICT OF INTEREST’ concern when a judge’s verdict benefits a HOA board that an obvious friend of hers sits on? Yes or no? Give me your answers and thoughts in the comment section below.

Additional insights, from a local perspective, were offered by the folks at dfwvoter.com where they also reported on statements Johnson made in a press release during her run for the Justice of the Peace in 2010,

It is important that the Justice of the Peace take into consideration the seriousness of the offense, the threat to the community, and sound legal principles before the bond is set.

The characteristics of good lawyering are the same as the characteristics of good judging–respect for people, respect for ideas, and respect for justice.

The Justice Court is commonly known as “The People’s Court” and it is her intent to see that the Court operates to quickly and fairly serve the community within the confines of the law.

Constant reports back to me are saying the Parker County residents are steaming over this issue and the air is full of buzz inside, and outside, about the Remuda Ranch Estates Homeowners Association. I have been receiving many documents, emails, and phone calls regarding this case.
